A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY MANAGER, OR THEIR DESIGNEES, TO EXECUTE A TRI-PARTY REVOCABLE LICENSE AGREEMENT BETWEEN BROWARD COUNTY, COCOMAR PROPERTY OWNER, LLC, AND THE CITY OF COCONUT CREEK FOR THE PURPOSE OF MAINTAINING SIDEWALKS, LANDSCAPING, AND OTHER IMPROVEMENTS WITHIN THE RIGHT-OF-WAY OF LYONS ROAD, NORTH OF ATLANTIC BOULEVARD, RELATED TO THE GREYSTAR COCOMAR DEVELOPMENT PROJECT.

BACKGROUND:
In November 2023, the City of Coconut Creek City Commission approved a site plan application for the development of an office/warehouse development complex located on the north side of Atlantic Boulevard at the northwest corner of Lyons Road. The approved site plan provided for public improvements along the Lyons Road frontage within Broward County's right-of-way (ROW), including but not limited to, a non-standard County sidewalk (shared-use path), landscaping, and irrigation (collectively referred to herein as "ROW Enhancements").
DISCUSSION:
Broward County requires that a local government and the Petitioner, Cocomar Property Owner, LLC, enter into a Revocable License Agreement that identifies the proposed landscape and hardscape improvements, authorizes access, and assigns the maintenance of materials and other improvements installed within its right-of-way.
In turn, this agreement assigns the maintenance responsibility for the proposed ROW Enhancements to the property owner, Cocomar Property Owner, LLC (the "Property Owner"). All improvements included in this agreement will be constructed and maintained by the Property Owner, in accordance with Broward County standards and City requirements, thereby ensuring the long-term maintenance of the Lyons Road corridor.
A second maintenance agreement will be forthcoming between the City and the Property Owner that will give the City the ability to assess fees and costs in the case of a default.
RECOMMENDATION:
Staff recommends approval of this resolution.
