BACKGROUND:

The City serves North Broward Preparatory School (NBPS) with domestic water and wastewater services.  Within the NBPS property, there are various water and wastewater facilities.  Over the years, there has been a duplication of efforts and/or misunderstanding in maintenance responsibility by NBPS and the City due to the expansion of facilities and joint ownership.  To alleviate these issues and for consistency in maintenance and functionality, in 2016, the City vacated all easements within the property, allowing all water and wastewater lines to be under one ownership, BMOC-MIA (FL), LLC.

DISCUSSION:

BMOC-MIA (FL), LLC, having ownership to all water and wastewater infrastructure within the school property, ensures no duplication of efforts, and/or any misunderstanding from a maintenance perspective.  However, the City is still the provider of water service, and as such, requires that usage be monitored for billing purposes.  This license agreement simply provides the necessary access to the water meters for this purpose, absent the original easements granted by NBPS. Through this action, the City is also granting the Bill of Sale for any water and wastewater infrastructure owned by the City within the subject property.    

RECOMMENDATION:

Staff recommends approval of this Resolution.
