BACKGROUND:

Section 287(g) of the Immigration and Nationality Act authorizes the Secretary of Homeland Security, or designee, to enter into written agreements with a state, or political subdivision of a state, to allow qualified officers the ability to perform certain functions of an immigration officer.

DISCUSSION:

This Memorandum of Agreement (MOA) provides the required terms and conditions for officers to assist Immigration and Customs Enforcement Officers with certain immigration enforcement while the officer is carrying out their regular duties. Officers will be provided mandatory training on administrative, legal, and operational issues tailored to the immigration enforcement functions to be performed under the MOA. Officers will have to pass an examination equivalent to those given to Immigration and Customs Officers. The MOA will remain valid until terminated by either party in writing.

RECOMMENDATION:

Staff recommends approval of this resolution.
