AN ORDINANCE AUTHORIZING THE MAYOR, OR DESIGNEE, TO EXECUTE THE SECOND AMENDMENT TO THE LEASE AGREEMENT WITH T-MOBILE SOUTH, LLC, WHICH PROVIDES FOR THE MODIFICATION OF EQUIPMENT ON THE CITY’S TELECOMMUNICATIONS TOWER AT THE COMMUNITY CENTER. (FIRST READING)

BACKGROUND:
The City owns the telecommunications tower (“Tower”) within the City-owned complex known as the Community Center, located at 1100 Lyons Road, Coconut Creek, Florida 33063. On June 23, 2016, the City and T-Mobile South, LLC (“T-Mobile”) entered into a lease agreement, through Ordinance No. 2016-20, to allow T-Mobile to perform a drop-and-swap of the then-existing telecommunications tower to construct the new monopole that currently exists at that location.
On October 26, 2023, the City approved Ordinance No. 2023-031, authorizing the Mayor to execute the First Amendment to the lease agreement, which provided for the ability to upgrade the equipment at the site and clarify several provisions within the lease agreement.
DISCUSSION:
The City and T-Mobile desire to amend the agreement a second time to modify the equipment on the Tower. The proposed equipment replacement will not increase the tower-loading, size, and/or amount of space utilized. Accordingly, the proposed modifications will not result in any change to the rent payable under the agreement. The City is committed to increasing the effectiveness of its communication equipment and maintaining a revenue source by permitting T-Mobile to modify the equipment on the communications tower.
