BACKGROUND:

In 2019, Broward County and participating Broward County Municipalities entered into a Memorandum of Understanding (MOU), providing for a collaborative study and subsequent development of an integrated solid waste and recycling system, and establishing a Solid Waste Working Group (SWWG), consisting of a group of elected municipal officials chosen from among the elected officials of the participating Broward County Municipalities and a County Commissioner.

In 2022, the SWWG agreed to engage a consultant to perform a waste generation study in order to further its efforts to agree on a regional solution for the future of solid waste disposal and the processing of recyclable materials in the future. The County hired the consultant and contributed fifty percent (50%) of the costs, while the participating municipalities paid the remaining fifty percent (50%) based upon population.

On May 25, 2023, the Coconut Creek City Commission, through Resolution No. 2023-090, approved the Interlocal Agreement for Solid Waste Disposal and Recyclable Materials Processing Authority of Broward County, Florida (“ILA”), the purpose of which was to create a solid waste authority (the “Authority”), to develop a plan (known as a “Master Plan”) to implement a long-term, environmentally-sustainable, economically-efficient plan and approach to disposal, reduction, recycling, and reuse of waste generated in Broward County including establishing ownership of such facilities.

As part of the Interlocal Agreement, the Authority was tasked to develop the Master Plan and a “Facilities Amendment” designed to address the disposition of Authority assets at the end of the Authority’s existence with such items to be developed within the first few years of the Authority’s existence.  This First Amendment implements the Master Plan and the Facilities Amendment.

DISCUSSION:

Eighty percent (80%) of the participating communities must pass this First Amendment within one hundred and twenty (120) days of the approval by the Authority’s Governing Board for the Authority to continue to exist.  The term of the ILA is forty (40) years from the effective date of August 16, 2023 with up to two (2) ten (10)-year extensions.  For Fiscal Year 2027 (FY27), the City’s contribution to the Authority will once again be approximately $70,000.  In FY 28, the Authority plans on implementing a tipping fee surcharge, which is anticipated to cost each residential unit approximately $3.00 per year.
