BACKGROUND:

Broward County Emergency Order No. 20-10 was issued on May 14, 2020, providing for a phased re-opening of business activity beginning on Monday, May 18, 2020, with restrictions in accordance with a modified Phase 1 of Governor Ron DeSantis’ Statewide re-opening plan in response to the COVID-19 pandemic.  To ensure a safe and efficient enforcement of the phased re-opening, pursuant to Section 8-56 of the Broward County Code of Ordinances, the County and municipalities countywide are authorized to implement and enforce the provisions of Emergency Orders issued by the County including, but not limited to, Emergency Order Nos. 20-10, 20-12, 20-13, and any subsequent Emergency Orders issued by Broward County.  

DISCUSSION:

Broward County has established a central 311 system (QAlert) for all complainant calls relating to alleged violations of the Emergency Orders and is desirous of having all municipalities provide consistent enforcement practices for such violations.  This Interlocal Agreement (ILA) is the proposed mechanism for the City to provide for enforcement of the Emergency Orders within the municipal boundaries by the City’s Code Compliance Officers.  As this is a countywide enforcement program, the expectation is that each municipality will enter into a similar ILA.  The public will be asked to call the 311 (QAlert) to report establishments that are in violation of the Emergency Orders.  The public will be able to register a complaint via telephone or on-line 24/7.  Through a Customer Relations Management System, each call will be documented, entered into a GIS database, and forwarded to the applicable City Code Department.  Residents will still have the option of calling the City directly, however, those calls/complaints will still need to be logged into the County’s system, pursuant to the ILA.  The ILA also provides for a monthly payment to the City of $13,900 through February 28, 2021. 

RECOMMENDATION:

Staff recommends approval of this resolution.

NOTES:                     The County shall provide a monthly payment to the City of $13,900, totaling an amount not to exceed $97,300 for the enforcement period. Funds will be deposited to Account 01-V34291, Public Safety Services.
