BACKGROUND:

Broward League of Cities (“BLOC”) and Broward County City Manager’s Association (“BCCMA”) have been working alongside Broward County staff to fine tune a plan to distribute the CARES Act funding (approximately $102.3 million, thirty percent (30%) of the total funding received by Broward County) among the 31 cities in Broward County. All parties recognize that time is of the essence as the CARES Act funding only applies to eligible expenses incurred starting on March 1, 2020, up to and including December 30, 2020, and not a day beyond that point. The proposed distribution plan establishes four (4) categories of expenditures and the formulas for capping funding allocations to each of the 31 cities in Broward County. Since the distribution schedule is not based in all cases on a per capita calculation, a draft template ILA is proposed to effectuate the plan.

DISCUSSION:

Since time is of the essence to distribute and use such federally allocated funding for the safety, stability, and vitality of our community and economy, the City Manager, or designee, must have the authority to negotiate and amend the subject ILA in substantially the form as Exhibit 1 provided any language changes thereto are nonmaterial, such agreements are consistent with the funding plan approved by the Commission, and such agreements are approved as to legal sufficiency by the Office of the City Attorney; and authorizing the City Manager to execute amendments to the Funding Agreements provided such amendments are consistent with the funding plan approved by the Commission and are approved as to legal sufficiency by the Office of the City Attorney.The more swiftly such funding can be used to effectuate its purpose, the better.
