This item was approved on First Reading at the November 12, 2020, City Commission Meeting.

The City desires to amend Chapter 13 of the Land Development Code, Code of Ordinances, Article I, entitled “Administration, Regulations and Procedures” by amending Division 4, entitled “Fee Schedules,” as it relates to building fees.  Pursuant to Section 13-80 of the City of Coconut Creek Land Development Code (“Code”), the City’s Fee Schedule is reviewed yearly to determine if any changes are warranted.  In certain instances, changes become necessary due to administrative actions at the State and County level. 

DISCUSSION:.

Over the last year, staff has conducted a review of the fee schedules in the Land Development Code and determined that minor changes are necessary and must be addressed due to changes made to the Florida Building Code (“FBC”) and Florida Statutes, as well as local amendments made and proposed by the Broward County Board of Rules and Appeals (“BORA”) with fee increases and state surcharge fee decreases.  Staff has also taken the opportunity to address certain minor corrections/clarifications relating to redundant fees or fees that are no longer necessary.  Below is a description of the changes, including:

                     Updating the fee schedule to reflect changes made to Broward County Board of Rules & Appeals fee and Building Code Administrators and Inspectors Fund - DCA fees - See Sec. 13-83 (4)(a) & (b);

                     Updating corresponding FBC sections to reflect new code section changes to the FBC 2020 - 7th Edition - See Sec. 13-83 (4)(g)(1-4);

                     Deleting fees that are no longer applicable due to changes in the Florida Statutes and Broward County Commission regulations -See Sec. 13-83(4)(n) & Sec. 13-86(3);

                     Removing redundant fees - See 13-83(4)(m), Sec. 13-84(6), Sec. 13-84(20); and

                     Removing driveways from Sec. 13-84(25) - driveways are now permitted through the Engineering Department.

RECOMMENDATION:

The Planning and Zoning Board, at its October 14, 2020, meeting, recommended approval of this ordinance.

NOTES:                     General Fund- Special Inspectors Fee T20830 and DCA Surcharge T20820.  It is anticipated that this amendment will result in a negligible fiscal impact.
