BACKGROUND:

This item was approved on First Reading at the October 14, 2021, City Commission Meeting.

The applicant, Pompano Autoplex, LLC, is requesting special land use approval to construct a new automobile dealership with a showroom, indoor service bays, and three-story parking structure to be located at 3757 Coral Tree Circle, generally located at the northwest corner of Sample Road and Coral Tree Circle.

The site, approximately five (5) acres in size, is Tract B-1 of the Tartan Coconut Creek Phase IV Plat. The property is currently zoned PUD (Tartan), Planned Unit Development. The Tartan PUD was originally approved by the City Commission in October, 1978. Since then, the Tartan PUD has undergone multiple revisions with a final amendment on November 19, 1984.

The subject property’s original site plan was approved in 1990 for the construction of a State Farm Insurance Claim Center. After State Farm closed and vacated the premises, the facility was remodeled by Waste Management, who occupied the building temporarily as offices and a training center. Waste Management vacated the property several years ago, and the building has remained vacant since.

Concurrently with this special land use application, the applicant is seeking approval of a site plan that will be a separate item on the agenda. An application for vacation of easements will be reviewed at a later date.

DISCUSSION:

The special land use request is to permit the development of a new Mazda Automobile Dealership.  The proposed development includes a two-story, 16,094 square foot main showroom with sales and administrative offices attached to a three-story structure immediately behind the showroom, providing 90,582 square feet of parts and equipment storage, ground floor service bays, and structured parking for inventory and employee parking.

The Tartan PUD does not provide a master business list specific to the commercial areas within the PUD. Where a PUD does not specify the types of businesses permitted within its boundaries, the B-3 (Community Shopping District) list is utilized for the purpose of determining permitted uses and special land uses. The B-3 District list specifies automobile dealerships as special land uses. 

The Planning and Zoning Board and City Commission must find that a special land use meets the general and specific standards outlined in Section 13-35, “Special Land Use,” of the Land Development Code based on competent and substantial evidence. City Staff finds that, subject to the conditions of approval in the ordinance, the applicant’s special land use request meets the general and specific standards for special land uses, as described in the staff report in the Planning and Zoning backup available online.

The Planning and Zoning Board at its September 8, 2021, meeting, recommended approval of the special land use application with the condition that a gate be installed at the north driveway entrance onto Coral Tree Circle. In addition to adding the gate condition, the Board requested that City staff and the applicant work to obtain a new address for the dealership. The new address would be on Sample Road instead of Coral Tree Circle to encourage customers to use Sample Road to visit the property.

RECOMMENDATION:

That the City Commission accept the recommendations of city staff and the Planning and Zoning Board from its September 8, 2021 meeting. Outstanding DRC comments are included in the Planning and Zoning backup and are available online for your review.

In addition to the Planning and Zoning Board recommendation, City staff further recommends the following conditions of approval:

1.                     Outstanding DRC comments remain effective throughout the development review process and shall be addressed prior to the issuance of a building permit.

2.                     Loading and unloading operations to be restricted to the same business hours of operation established herein.

3.                     Loading vehicles shall not wait on subject property or street right-of-way prior to opening hours.

4.                     No outdoor loudspeakers shall be allowed on site, except in connection with a surveillance security system.

5.                     Vehicle test driving shall be limited to arterial roadways such as Sample Road or Lyons Road.  No residential streets will be used for this purpose except for the portion of Coral Tree Circle used to access Sample Road from the southern entrance to the property. Test driving of vehicles using the north access driveway is prohibited.

6.                     No vehicle may be displayed on elevated or inclined ramp, with its hood up, trunk lid up or doors open.

7.                     Hours of operation may be expanded by resolution of the City Commission (without the need for an amendment to the Special Land Use ordinance) upon application by the owner. Proposed hours are:

Showroom:       Monday to Friday                     - 9 am to 9 pm

                         Saturday                                          - 9 am to 7 pm

                         Sunday                                          - 11 am to 5 pm

Service:                      Monday to Saturday - 7:30 am to 6 pm with after-hours pickup and drop off.

8.                     Parking of vehicles on site for various purposes (i.e. new display, used display, customer and employee) shall only be in the designated parking spaces consistent with the approved site plan.

9.                     Prior to the issuance of a Certificate of Occupancy, the specialty paving treatments on the sidewalk and roadway on Coral Tree Circle at the intersection of Coral Tree Circle and Sample Road shall be cleaned, painted, or removed and replaced accordingly.

10.                     Within 90 days following the adoption of this ordinance, the property owner shall submit the necessary City development review applications for the installation of a decorative automatic gate at the north driveway onto Coral Tree Circle.  The gate shall provide a Knox gate switch or Knox padlock to permit City or emergency vehicle access at all times of the day.  City staff shall work with the property owner to determine the appropriate times of the day the gate will be opened and closed to the public, the design, location, and other planning and engineering issues subject to traffic engineering and site plan standards. The gate shall be permitted, installed, and operational prior to the issuance of a Certificate of Occupancy.  

FISCAL IMPACT: N/A
