BACKGROUND:

This item was approved on First Reading at the August 24, 2023, City Commission Meeting.

The applicant, Jay Huebner of HSQ Group, Inc., on behalf of the owner, TT of Sample, Inc., is requesting to amend the City’s Land Development Code to include the permitted and special land uses for the Infiniti-Lincoln of Coconut Creek Planned MainStreet Development District (PMDD). Specifically, the applicant proposes to amend Chapter 13, Article III, Division 8, “Master Business List” to create Section 13-626, which will be a new Master Business List for the PMDD zoning category.

Unlike the Master Business Lists for the Business (B), Industrial (I), and Office (O) Districts, individual PMDD lists were previously not codified and are kept on file in the Sustainable Development Department. There are seven (7) individual PMDDs in the City of Coconut Creek MainStreet Project Area (MSPA). In an effort to increase transparency for businesses, property owners, and individuals seeking information on permitted and special land uses for properties in a PMDD, City staff is working with applicants/property owners to codify permitted and special land use lists as PMDDs are newly-amended or created.     

The attached ordinance accompanies the agenda items relating to the rezoning ordinance, adopting the Infiniti-Lincoln of Coconut Creek PMDD regulating document, and the corresponding site plan ordinance. 

DISCUSSION:

The existing Infiniti PMDD, adopted in 2017, permitted automobile sales and service-related business uses. The proposed amended list, which would have been previously embedded in the new Infiniti-Lincoln of Coconut Creek PMDD regulating document, will now be codified as part of Section 13-626, “Master Business List - Planned MainStreet Development District,” under an “Infiniti-Lincoln of Coconut Creek PMDD” column heading. The proposed list will feature the same business uses that are currently permitted in the PMDD.   

RECOMMENDATION:

The Planning and Zoning Board, at its June 14, 2023, meeting, recommended approval of the ordinance, and City staff recommends approval of the ordinance.
