BACKGROUND:

At the November 9, 2023 City Commission meeting, the City Commission adopted Resolution No. 2023-097, which approved the site plan request for the development of a light industrial, flex space, and warehouse project generally located at the northwest corner of Atlantic Boulevard and Lyons Road. The site plan approval included several conditions, including Condition 5.m., which requires the applicant to construct and maintain a 4,000 square foot publicly-accessible community garden on the project site and provide the City and the general public with legal access to the community garden area.

DISCUSSION:

The applicant has submitted the landscape plans for permitting review and has coordinated with the Resilient Design & Development Department and the City Attorney’s Office to draft the attached Access Easement Agreement for the purposes of providing access to and use of the garden area. The community garden will include a passive garden area accessed by a grass trail that connects to the new multiuse sidewalk along Lyons Road. The garden will be planted with a variety of pollinatorfriendly species, including two (2) tree species and ten (10) plant species selected to support butterflies and other pollinating insects. This diverse mix of vegetation will create an inviting habitat that enhances ecological health and encourages pollination activity. The agreement also includes a maintenance plan for which the applicant remains responsible.

RECOMMENDATION:

Staff recommends approval of this resolution.
