A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE AMENDMENT NUMBER TWELVE (12) TO THE FLORIDA DEPARTMENT OF TRANSPORTATION DISTRICT FOUR INCLUSIVE LANDSCAPE MAINTENANCE MEMORANDUM OF AGREEMENT FOR THE PURPOSE OF MAINTAINING SIDEWALKS, LANDSCAPING, AND OTHER IMPROVEMENTS WITHIN THE RIGHT-OF-WAY OF WEST HILLSBORO BOULEVARD (STATE ROAD 810) ASSOCIATED WITH THE HILLSBORO MARKETPLACE DEVELOPMENT PROJECT.

BACKGROUND:
In September 23, 2021, the City of Coconut Creek approved a site plan application submitted by The Keith Company on behalf of Hillsboro Marketplace Investments, LLC, for modifications to a previously-approved site plan for the shopping center located on the north side of Hillsboro Boulevard at the northeast corner of Lyons Road. Along the Hillsboro Boulevard frontage, the proposed public improvements that encroach within the Florida Department of Transportation (FDOT) right-of-way include, but are not limited to, a non-standard FDOT sidewalk, landscaping, and irrigation. FDOT has requested an amendment to the previously approved District Four Inclusive Landscape Maintenance Memorandum of Agreement (MMOA) to authorize the developer to construct these above-described improvements within the Hillsboro Boulevard right-of-way.
DISCUSSION:
The City seeks to provide first-class amenities for users of the Hillsboro Boulevard corridor and to implement the public improvements identified in the Hillsboro Marketplace site plan approval. The proposed improvements are generally located within the Hillsboro Boulevard right-of-way and/or on property owned by Hillsboro Marketplace Investments, LLC. FDOT maintains right-of-way jurisdiction over Hillsboro Boulevard. The design elements included in this public improvement project represent enhanced features that exceed the standard improvements typically provided by FDOT.
FDOT requires the City to amend the existing District Four Inclusive Landscape MMOA to designate the City of Coconut Creek as responsible for the perpetual maintenance of the subject improvements. The shopping center developer is responsible for obtaining all required FDOT permits to complete the construction of the sidewalk and other amenities. As part of the permitting process, execution of the twelfth amendment to the District Four Inclusive Landscape MMOA is required. The City Engineer has reviewed and approved the typical section and project plans. By separate resolution, the City will enter into an agreement with Hillsboro Marketplace Investments, LLC to reassign the maintenance obligations to the adjacent property owner implementing the improvements.
