BACKGROUND:

This item was approved on First Reading at the September 10, 2020, City Commission Meeting.

The owners, Vista Gardens Ballroom, LLC and the City of Coconut Creek, are requesting a rezoning approval from A-1 (Agricultural) and O-2 (Local Office) to B-3 (Community Shopping). The subject property is located at 5011 West Hillsboro Boulevard between State Road 7 and Lyons Road.  The subject property consists of two separate sites. The property on the east, approximately 1.58 +/- acres, is the site of the former and now closed Deenie’s Hideaway, a private club use. The adjacent property on the west, approximately 0.88 +/- acres, is a portion of the previously platted Janis Plat, which was acquired by the City of Coconut Creek and is under contract for purchase by Vista Gardens Ballroom, LLC for inclusion in this project.

DISCUSSION:

As currently proposed, the owners are seeking rezoning approval to accommodate the development of a catering and meeting hall with ancillary recreational amenities for social events such as weddings, bar-bar mitzvahs, and corporate events.  This project is considered a significant redevelopment opportunity for the Hillsboro Corridor Redevelopment Area and is consistent with the vision previously established in the City’s Redevelopment Grant with Broward County.  Vista Gardens Ballroom, LLC has proffered a Declaration of Restrictive Covenants as described below.

Concurrent with this application, land use plan amendment, plat, special land use, and site plan applications are under review and consideration.

 

PUBLIC INVOLVEMENT:

Per Section 13-36 (c), property owners within 500 feet of the subject property were notified by mail of the rezoning request and invited to attend the Planning and Zoning Board and City Commission meetings. One hundred and thirty (130) public notices were mailed by the City on July 29, 2020, and August 27, 2020 respectively. A notice of rezoning public hearing sign was also posted on the property 14 days prior to the Planning and Zoning Board and City Commission meetings. 

As part of the related site plan application review process, the applicant was required to perform community outreach and provide project information to neighboring property owners and hear and address concerns and issues raised through this process.  A neighborhood participation meeting, intended to provide a forum for surrounding residents and business owners but open to the public, was held Monday, October 28, 2019, at 6 p.m. at the City’s Recreation Complex located at 4455 Sol Press Boulevard.  Residents and business owners were invited to attend the meeting and hear project details and grant and redevelopment efforts from the applicant and the City related to the project and Hillsboro Boulevard Redevelopment.  A second community meeting was scheduled for March 19, 2020, but was postponed due to the current pandemic.  However, the applicant reached out to the residents to continue working through and addressing resident concerns.

As a result, the applicant/property owner has proffered the following conditions to be addressed through a declaration of restrictive covenants to be maintained on the property by the property owner and transferred to any new owner in perpetuity.

 

The following uses shall not be permitted on the property:

                     Ambulatory surgical center

                     Automobile dealership

                     Automobile parts

                     Automobile & truck rental agency

                     Automobile tag agency

                     Coin operated laundromats

                     Hotels/motels

                     Liquor store

                     Medical marijuana dispensary

                     Motorcycle & recreation vehicle sales & service

                     Private clubs and lodges

                     Retail electronic-cigarette/vaporizer store

                     Video stores

 

The Declaration of Restrictive Covenants proffered by Vista Gardens Ballroom, LLC limiting the uses on the property is attached and proposed as a condition of approval of the rezoning.  Additional development/design requirements were proffered by the applicant and are discussed as part of the special land use application.

RECOMMENDATION:

The Planning and Zoning Board, at its August 12, 2020, meeting, recommended approval of the rezoning application subject to the condition that outstanding DRC comments remain effective throughout the development review process and must be addressed prior to issuance of a building permit.  Outstanding DRC comments are included in the Planning and Zoning Board Agenda backup and are available online for your review.
