A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE AMENDMENT NUMBER TEN (10) TO THE DISTRICT FOUR LANDSCAPE INCLUSIVE MAINTENANCE MEMORANDUM OF AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) FOR THE PURPOSE OF MAINTAINING SIDEWALKS, LANDSCAPING, AND OTHER IMPROVEMENTS WITHIN THE RIGHT-OF-WAY OF HILLSBORO BOULEVARD (STATE ROAD 810) RELATED TO THE LEDER SELF-STORAGE DEVELOPMENT PROJECT.

BACKGROUND:
In October of 2022, the City of Coconut Creek approved a site plan application for Keith and Associates on behalf of the property owner, 4161 Hillsboro, LLC, for a self-storage facility located at 4161 West Hillsboro Boulevard. Along the Hillsboro Boulevard frontage, the proposed public improvements within the Florida Department of Transportation (FDOT) right-of-way include, but are not limited to, a non-standard FDOT sidewalk, landscaping, and irrigation. FDOT has requested an amendment to a previously-approved District Four Landscape Inclusive Maintenance Memorandum of Agreement (MMOA) to allow the developer to construct the above-described improvements within the Hillsboro Boulevard right-of-way.
DISCUSSION:
The City desires to provide first class amenities to the users of the Hillsboro Boulevard corridor and to effectuate the public improvements identified in the 4161 Hillsboro Boulevard Self-Storage Site Plan approval. The proposed improvements are generally located within the Hillsboro Boulevard right-of-way and/or on land owned by 4161 Hillsboro, LLC. FDOT has right-of-way jurisdiction over Hillsboro Boulevard. The design elements proposed as part of this public improvement project are featured items that are above those that are typical FDOT products.
FDOT requires that the City amend the existing District Four Landscape Inclusive MMOA to designate perpetual maintenance of the subject improvements to the City of Coconut Creek. The self-storage developer is responsible for securing the required FDOT permits to complete the sidewalk construction and other amenities. The permit requirements include execution of the tenth amendment to the District Four Landscape Inclusive MMOA. The City engineer has reviewed and approved the typical section and plans for the project. By separate resolution, the City will enter into an agreement with 4161 Hillsboro, LLC to re-assign the maintenance obligations to the self-storage property owner.

Staff recommends approval of this resolution.
