BACKGROUND:

This item was approved on First Reading, at the December 14, 2023, City Commission Meeting.

The applicant, Scott Backman of Dunay, Miskel & Backman, LLC, on behalf of the property owner, David Auld of Johns Family Partners, LLLP, is requesting to amend the City’s Land Development Code to include the permitted and special land uses for the MainStreet @ Coconut Creek Planned MainStreet Development District (PMDD). Specifically, the applicant proposes to amend Chapter 13, Article III, Division 8, “Master Business List” to add an additional column to the list in Section 13-626, which is the new Master Business List for PMDDs.

Unlike the Master Business Lists for the Business (B), Industrial (I), and Office (O) Districts, individual PMDD lists were previously not codified and kept on file in the Sustainable Development Department. There are currently seven (7) individual PMDDs in the City of Coconut Creek MainStreet Project Area (MSPA). In an effort to increase transparency for businesses, property owners, and individuals seeking information on permitted and special land uses for properties in a PMDD, City staff is working with applicants/property owners to codify permitted and special land use lists as PMDDs are newly created or amended.

The attached ordinance accompanies the agenda items relating to the rezoning, adopting the MainStreet @ Coconut Creek PMDD regulating document and the amendments to the MainStreet @ Coconut Creek Development of Regional Impact (DRI) Development Order Ordinance. 

DISCUSSION:

The permitted and special land uses proposed in the MainStreet @ Coconut Creek PMDD will be codified as part of Section 13-626, “Master Business List - Planned Mainstreet Development District,” under a “MainStreet @ Coconut Creek” column heading. The proposed list allows for general commercial/retail, office, and residential uses consistent with the MainStreet Design Standards, as specified in the attached ordinance.

RECOMMENDATION:

The Planning and Zoning Board, at its October 11, 2023, meeting, recommended approval of the ordinance subject to approval of the MainStreet PMDD Rezoning.

City staff finds the Land Development Code amendment request consistent with the City’s Comprehensive Plan and recommends approval subject to the City Commission approving the MainStreet PMDD Rezoning Ordinance No. 2023-033.
