BACKGROUND:

The property owner, Apostolic Mission of Christ, Inc. (“Apostolic Mission”), is seeking site plan approval for the development of a house of worship, in accordance with Chapter 13, Land Development Code, and with the Lyons West Planned Unit Development (PUD) zoning regulations. The previous owner, the Archdiocese of Miami (Archdiocese), operated the St. Luke Parish on the subject property for many years.  Special Land Use Ordinance No. 2012-009, provides for a religious education center and parish as Phase I and a Phase II site plan to include the future worship hall.  In 2016, the property was sold and the current property owner, Apostolic Mission, acquired the property from the Archdiocese.

In 2023, Apostolic Mission received administrative site plan approval to locate a modular building on the subject property for two (2) additional classrooms to provide education through 12th grade, pursuant to the conditions previously approved in Ordinance No. 2012-009.  Apostolic Mission currently uses existing buildings on the subject property for religious and educational uses. 

DISCUSSION:

The subject property, approximately 9.2+/- acres, is located at 2730 Hammock Boulevard, just south of Copans Road at the main entrance to the Buttonwood Hammocks single family community. Apostolic Mission is proposing to construct a new 11,795 square foot place of worship consisting of six (6) classrooms, administrative office space, and a seventy-five (75) seat worship hall. The site will maintain the existing one hundred eleven (111) developed parking spaces that will also serve the new facility. Two (2) existing access points on Hammock Boulevard will remain as currently constructed with no new access proposed and no changes to onsite traffic circulation.

All required landscape buffers and setbacks that currently exist on the subject property will be maintained to provide adequate buffers for adjacent uses. Landscape deficiencies will be corrected prior to the issuance of a Certificate of Occupancy for the new facility. Apostolic Mission proposes to provide both religious services and private education.

Public Involvement

As part of the application review process, the applicant was required to perform community outreach in an effort to provide project information to neighboring property owners and neighborhood associations, as well as hear and address concerns and issues raised through this process. The applicant has submitted a Community Outreach Summary for this project, which is included as part of the agenda backup for this application. Key efforts resulting from their outreach included a meeting held at the subject property at 2730 Hammock Boulevard on December 12, 2022, from 4:00 p.m. to 6:00 p.m., which was intended to provide a forum for area residents. To date, staff has not received any resident inquiries related to the project.

RECOMMENDATION:

City staff finds the proposed site plan application, subject to conditions listed below, to be in compliance with Chapter 13, Land Development Code, and with the Lyons West PUD zoning regulations and recommends approval.    

The Planning and Zoning Board, at its August 9, 2023, meeting, recommended approval of the site plan application subject to the conditions of approval recommend by City staff. Outstanding DRC comments are included in the Planning & Zoning Board Agenda backup and are available online for your review:     

1.                     Prior to the issuance of a Certificate of Occupancy by the City’s Building Division, all landscape deficiencies, including trees, will be corrected consistent with approved plans and the City’s Landscape Code. 

2.                     All other outstanding DRC comments remain effective throughout the development review process and must be addressed prior to the issuance of a building permit unless otherwise state therein.
