A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE AN AGREEMENT WITH KLEMOW AT 5100 HILLSBORO, LLC AND FIRST BAPTIST CHURCH AT COCONUT CREEK, INC. (DEVELOPERS) FOR THE DESIGN AND CONSTRUCTION OF IMPROVEMENTS TO THE COCONUT CREEK 69TH STREET GREENWAY AND THE ASSOCIATED CONSTRUCTION AGREEMENT.

BACKGROUND:
In 2009, the City completed the Coconut Creek 69th Street Greenway connection between the eastern limits of Carl’s Furniture/Cusano’s Bakery and the C-5 Canal (“Greenway”). Funding for this project was provided through a Florida Department of Environmental Protection (FDEP) Greenways and Trails Grant. Broward County subsequently constructed the bridge connection over the C-5 canal, providing access to the existing greenway link east of the canal through to Lyons Road. Due to grant/budget limitations, the 2009 project only included an 8 to 12 foot meandering concrete path, with landscaping and irrigation to be constructed at a later date.
Over the last several years, with the review, approval, and ongoing construction of the Long Pines and In the Pines townhouse projects, along with First Baptist Church, the owner/developers for these projects, Klemow at 5100 Hillsboro, LLC and First Baptist Church at Coconut Creek, Inc. (Developers), have agreed to complete all of the missing components of the Greenway, including lighting, landscaping, and irrigation while they are completing the segments directly adjacent to their property. Taking this more comprehensive approach, the Greenway will serve as a true linear park and greenway connection from end to end.
DISCUSSION:
There are two purposes for the attached Agreement (Exhibit “1”). First, the Agreement will authorize the Developers to complete this City construction project within our right-of-way, in accordance with the Construction Agreement (Exhibit “A”) between the City and Klemow at 5100 Hillsboro, LLC and First Baptist Church at Coconut Creek, Inc., while they are mobilized and working on their respective development projects. This approach is projected to save the City $90,000. Second, the overall Greenway project features approximately 2,200 linear feet of landscaping and irrigation with a cost estimate of approximately $300,000. This Agreement provides for the allocation of $150,000 in park impact fees, required at the time of the rezoning approval for the In the Pines and First Baptist Church at Hillsboro project, pursuant to Ordinance No. 2015-012. The Ordinance provides that all or a portion of the cash donation may be offset by developer improvements to the 69th Street Greenway project. This Agreement also provides for the allocation of $60,000 from the existing Greenway Enhancement Capital Improvement Program towards the construction cost of the project. The remaining costs, estimated to be approximately $90,000, shall be paid by the Developers. Staff recommends authorization of this allocation given that the overall project boundaries extend beyond the limits of the townhome and church projects, and given the nature of the Greenway project as a linear park and the proximity of the amenity to the new residential and community uses. For reference, Klemow at 5100 Hillsboro, LLC previously contributed $102,500 as park impact fees for the completed Long Pines development, which was utilized for other offsite City park improvements.
Once the Greenway improvements have been completed and inspected, the City would assume maintenance responsibility for the improvements.
