BACKGROUND:

The Hale Planned Commerce District (PCD), approximately 20+/- acres overall, includes the existing Walgreens Pharmacy, Dave Thomas Education Center, and the Strada Development, generally located at the south west corner of Coconut Creek Parkway and Lyons Road.

The Hale Plat, originally recorded in 1988, provided a ten (10) foot utility easement running along the north, south, and east property lines.  In 2005, a master site plan for the Strada Development was approved by the Planning and Zoning Board that included multiple retail/office buildings, a bank, and limited service, four-story hotel with 86 rooms at the southern portion of the Strada site.

DISCUSSION:

The applicant, Craven Thompson & Associates, is seeking approval to vacate a portion of the ten (10) foot utility easement running along the south property line.  The portion of the utility easement to be vacated is limited to the area immediately abutting the proposed hotel site only.  As required, the applicant has provided correspondence from affected utility companies, and have determined that only an AT&T service line currently exists within the utility easement.  The applicant has agreed to remove and relocate the utility line in accordance with utility requirements and a new easement will be recorded as required if the associated site plan is approved.  This site plan is dependent upon a special land use application.

In accordance with the City’s Land Development Code, larger maturing landscape material may not be located within a utility easement.  If approved, the vacated easement will allow the installation of the proposed landscape buffer, including trees along the south property line, adjacent to the proposed hotel.

PUBLIC INOLVEMENT:

Per Section 13-36.1(e)(1)(c), property owners within 500 feet of the subject property were notified by mail of the vacation of easement request and invited to attend the City Commission meeting.  One hundred and twenty-five (125) notices were mailed by the City on June 14, 2018. 

 

RECOMMENDATION:

The Planning and Zoning Board, at its May 9, 2018, meeting recommended approval of this application subject to the condition that outstanding DRC comments remain effective throughout the development review process and must be addressed prior to issuance of a building permit.  Outstanding DRC comments are included in the Planning and Zoning Board Agenda backup and are available online for review.  Please note that this vacation application requires two readings and the necessity for this action is tied to the proposed site plan.  This sit plan is currently scheduled for July 12, 2018 and requires an affirmative action on the special land use application.
