BACKGROUND:
The City of Coconut Creek owns Track E of the Commerce Center of Coconut Creek, commonly known as the Butterfly Parking Lot. The City and the Seminole Tribe of Florida d/b/a Seminole Indian Casino-Coconut Creek have an ongoing Use Agreement that was approved at the December 14, 2023, City Commission Meeting. This agreement allows the Seminole Indian Casino-Coconut Creek to use this property for continued temporary and non-exclusive overflow parking throughout the year.
Under the terms of that agreement, the City retains the right to designate portions of the lot for specific purposes, including but not limited to, temporary parking for other users engaged in economic development activities. Consistent with this authority, the City Commission approved Resolution No. 2024-024 in February 2024, authorizing a Temporary Use Agreement with Infiniti-Lincoln for vehicle storage during construction of its new showroom facility. Following the expiration of that agreement, the City Commission subsequently approved a new Temporary Use Agreement in February 2025.
DISCUSSION:
To support ongoing construction activities within the City, TT of Sample, Inc. has requested the continued temporary use of approximately 0.93 acres of City-owned property for vehicle storage and employee parking and has agreed to enter into a lease agreement for this purpose. The proposed leased area will be used solely for temporary parking as the dealerships finish up construction details and shift inventory.
The attached Lease Agreement provides for the temporary use of approximately 0.93 acres of City-owned property for vehicle storage and employee parking for an initial term of three (3) months from the date of execution.
Pursuant to the agreement, TT of Sample, Inc. shall pay rent to the City in the amount of Eighteen Thousand Two Hundred Dollars ($18,200.00) per month, plus applicable sales tax, for the duration of the initial term, or any portion thereof. The agreement further authorizes the City Manager, or designee, to approve one (1) additional three (3)-month extension under the same terms and conditions, if necessary. In addition, the agreement includes a holdover provision applicable to any period beyond the initial term that is not formally extended, or beyond the authorized extension term.
The agreement also includes standard provisions relating to maintenance, insurance, temporary vacation of the premises in the event of a City function or activity, emergency vacancy requirements, and restoration of the leased premises upon termination.
Staff believes that permitting this temporary use supports continued economic activity within the City while ensuring appropriate safeguards and protections for City-owned property.
RECOMMENDATION:
Staff recommends approval of this resolution.
