BACKGROUND:

 

The City of Coconut Creek administers development impact fee programs to maintain levels of service in capital facilities in a manner consistent with the City’s Comprehensive Plan. These impact fee programs ensure that development bears a proportionate fair share of the costs that are necessary to adequately provide additional governmental and capital facilities to serve the future needs of the project.  

 

The City’s current development impact fees consist of the following: 

 

1.                     Parks and Recreation (adopted 1980’s);

2.                     Fire and Rescue (adopted 2006);

3.                     Police (adopted 2006); and

4.                     Affordable Housing Linkage (adopted 2006).

 

A crucial part of administering any impact fee program is that it must be consistent with current Florida laws and best practices in growth management. As shown above, the current impact fee programs have not been updated since the middle 2000’s or before.  There are also additional programs the City may want to consider going forward to address development impacts relating to transportation, sustainability, stormwater, and government facilities.

DISCUSSION:

 

The purpose of the impact fee study is to review, evaluate, and recommend revisions and updates to the City’s existing development impact fee programs to ensure they are consistent with legal requirements and adequately provide for infrastructure required for new development. The study will also evaluate the need and feasibility of establishing the following new impact fee programs:

 

1.                     Transportation Mobility Fee;

2.                     Sustainability Impact Fee;

3.                     Stormwater Impact Fee; and

4.                     Government Facilities Impact Fee.

 

In addition to studying existing and new impact fees, the consultant will evaluate the City’s Public Art Requirement ordinance to determine whether or not any revisions to the Code Section, methodology, or requirements are needed based on current law and best practices in public art regulations. Finally, the City is also interested in any other impact fee that may be recommended by the study.

 

All studies, data analysis, methodologies, and recommendations will incorporate best practices and innovative approaches in municipal impact fee programs that will maintain the City’s high standards for excellence, sustainability, and fiscal stewardship.

 

The City issued a competitive solicitation for these services, and received three submittals, one of which, KorKat (Lanier Plans Inc.), was withdrawn from the solicitation and was not considered by the selection committee.  The selection committee, consisting of Karin Lu, Assistant Finance Director; Justin Proffitt, Assistant Director of Sustainable Development; Randall Blanchette, Engineering Manager; Kathy Mehaffey, Deputy City Attorney; and Liz Aguiar, Sustainable Development Principal Planner, reviewed and evaluated the remaining two submittals.

 

After an extensive evaluation process, which included, review of each firm’s personnel, past record, experience, areas of expertise, office location, and current and projected workloads, the selection committee ranked Alfred Benesch & Company, formerly known as Tindale-Oliver & Associates, Inc., number one as the most highly qualified, responsive and responsible proposer. Having determined that they were the highest ranked, most responsive and responsible bidder, the committee made a recommendation to award the contract to Alfred Benesch & Company.

Staff recommends approval of this resolution.
