BACKGROUND:

Ordinance No. 2014-140 was passed on first reading on December 11, 2014.  As a small scale amendment, upon adoption the amendment will be transmitted to the Florida Department of Economic Opportunity for their records.  There is no review and comment period at the state level for small scale amendments.

The applicant, James W. Waldman, is requesting approval of a land use plan amendment to the City of Coconut Creek Future Land Use Plan Map, for a 4+ gross acre site located at 4000 NW 74th Street.  The request is to amend the land use designation from Estate 1.0, Residential Estate 1 DU/Ac to Low 5.0, Residential 5 DU/Ac.

Currently, the 4+ acre site has an Estate 1.0 DU/Ac Land Use Designation which would permit up to a maximum of four (4) dwelling units.  The applicant is requesting a land use change to Low 5.0, Residential 5 DU/Ac, which would allow up to five (5) units per acre resulting in a proposed maximum of 20 units.  Surrounding the site on the west, north and east is a mix of vacant residential parcels and estate homes both within the City’s Municipal Boundary and in unincorporated Broward County.  Immediately to the south, is the existing Crescent Creek Residential Development which has an existing land use designation of Low 5.5 DU/Ac.

Although staff has maintained concerns related to the compatibly with other properties in the neighborhood if the proposed development were to follow typical single family development patterns, the applicant has voluntarily proffered very detailed architectural standards that would result in a fourplex unit type designed to appear as large single family homes.  A conceptual development plan was also submitted as supporting documentation with the application, which provides for five (5) residential structures on the site, each with 4 dwellings units, laid out in a “campus-like” style with common areas, parking and a perimeter buffer.  Only with this supporting documentation, which is considered to be formal commitments for future development, do we feel it is appropriate to move forward with this LUPA.  In addition, as with first reading, staff has provided notification to the adjacent property owners of this hearing so that they may provide public comment as to neighborhood compatibility to support a finding of compatibility by this board.

DISCUSSION:

After first reading by the City Commission on December 11, 2014, the application was submitted to Broward County for review and approval.  The application was considered by the Broward County Planning Council on April 23, 2015 and May 28, 2015 and recommended for approval to the Broward County Commission.  The County Commission approved the amendment on June 23, 2014.  If approved on second reading by the City Commission, the applicant will be required to process plat, rezoning and site plan applications which will be presented to the Planning and Zoning Board and City Commission as applicable.

RECOMMENDATION:

The Planning and Zoning Board, at its October 8, 2014 meeting, recommended approval of this application to the City Commission.   The City Commission approved Ordinance 2014-027 (First Reading) on a 3-1 vote on December 11, 2014.
