BACKGROUND:

In 2011, the Broward County Commission expanded the “Broward County Elected Official Code of Ethics” (Ethics Code) to apply to all municipal elected officials in Broward County, their specified relatives, and their office staff. A portion of the Ethics Code prohibits cities from supporting non-profit charitable organizations with cash or in-kind services unless the organization is sponsored by the supporting City. Additionally, contained within the Ethics Code are reporting requirements for elected officials who solicit funds on behalf of non-profit charitable organizations. An exception to the reporting requirement occurs when the governing body formally approves the lawful solicitation or fundraising efforts for designated non-profit charitable organizations or fundraising events.

DISCUSSION:

This resolution authorizes sponsorship of designated non-profit charitable organizations through means of fundraising events, City sponsorship activities, cash donations, and/or in-kind services. At the same time, the City Commission also authorizes personal solicitations on behalf of individual City Commissioners for the designated non-profit charitable organizations without the need for reporting same under the Broward County Ethics Code for only those designated charitable organizations referenced in the resolution attached hereto. Please note as part of the Parks and Recreation study, staff is evaluating all in-kind contributions to non-profit organizations; therefore, this list may change.

RECOMMENDATION:

Staff recommends approval of this resolution.
