BACKGROUND:

This item was approved on First Reading at the December 9, 2021, City Commission Meeting. Following that meeting, City staff transmitted the ordinance and Work Plan to the Department of Economic Opportunity (DEO) and South Florida Water Management District (SFWMD) for review. The SFWMD provided comments to City staff requiring revisions to the Work Plan and additional minor clarifying amendments to the City’s Comprehensive Plan. The additional plan amendments relate to updating potable water levels of service indicators to be consistent with the Cities of Margate, Parkland, and the Broward County Water and Wastewater Services (BCCWS). The other minor amendments are to the Intergovernmental Coordination Element. The proposed amendments can be found in Sections 2 and 3 of the second reading ordinance and on page 45 of 53 of the Work Plan.

Staff recommends approval of the ordinance and adoption of the revised Work Plan. 

In the middle 2000s, the Florida Legislature enacted legislation updating sections within Chapters 163 and 373 of the Florida Statutes to strengthen the statutory links between the regional water supply plans prepared by the water management districts and the comprehensive plans prepared by local governments. In addition, the legislation established the basis for improving coordination between local land use planning and water supply planning. 

Water supply work plans include population projections and potential water usage estimates, alternative water supplies, water reuse, conservation programs, and are incorporated into a local government comprehensive plan. In addition, all local governments must address water supply in their concurrency management programs.

The City of Coconut Creek is located within, and is governed by, the South Florida Water Management District (SFWMD), and its water is supplied by two sources: the City of Margate Utility Department and Broward County Water and Wastewater Services - District 2. The SFWMD implements the Lower East Coast Water Supply Plan that applies to all water service providers and users, and periodically updates the plan per statutory requirements. The City’s first Work Plan was adopted in 2008 with a subsequent update in 2015.  Since that time, a new SFWMD Lower East Coast Water Supply Plan Update was approved in 2018.

DISCUSSION:

The purpose of the City of Coconut Creek Water Supply Facilities Work Plan (Work Plan) is to identify and plan for the water supply sources and facilities needed to serve existing and new development within our service area for at least a ten (10) year planning period, from 2020 to 2030.

Areas of the City of Coconut Creek receive water from the City of Margate (South Creek provider) and Broward County (bulk purchase). The Work Plan incorporates the Margate and Broward County work plans to ensure consistency among the different agencies. Most of the technical data included in our plan comes directly from these two provider plans.  

The following changes are being made in this update to the City’s Work Plan:

 

                     Updated terminology and data source references;

                     Updated population estimates to be consistent with our water provider plans; and

                     Incorporation by reference into the City’s Comprehensive Plan.

The attached Work Plan shall be adopted by reference into the City’s Comprehensive Plan.  As such, staff is processing this as a formal amendment to the City’s Comprehensive Plan. The following underlined text is proposed as an amendment to the Infrastructure Element, GOAL V-a, Objective V-a-1, of the City’s Comprehensive Plan:   

Objective V-a -1

Continue to coordinate with Broward County and the City of Margate to ensure that the adopted level of service standards for potable water are maintained to meet the City’s current and anticipated demands. For the 10-year planning period covered by the following documents, the City of Coconut Creek hereby adopts and incorporates here by reference its “South Florida Water Management District, Water Supply Facilities Work Plan for the City of Coconut Creek, Florida,” prepared by Eckler Engineering, Inc. dated August 31, 2021, under project number 228-008.00, the “Broward County Water Supply Facilities Work Plan (2020 Work Plan)” adopted by the Broward County Board of County Commissioners on April 21, 2020, and the “City of Margate Water Supply Facilities Work Plan Update,” prepared by Hazen and Sawyer, P.C., dated April 24, 2020. The Work Plans address issues that pertain to water supply facilities and requirements needed to serve current and future development within the City of Coconut Creek. 

In general, the changes to the City’s Work Plan are relatively minor. Population estimates, data and analysis sources, water supply projects, and water conservation initiatives and policies are still effective and consistent with the current state and regional planning agencies. At this time, no significant revisions are recommended by City staff. 

Following City Commission approval of the proposed amendment on first reading, staff will transmit it to the various state and regional planning review agencies for review and comment. City staff will make revisions per those agency comments, if any, and then schedule a second reading of the proposed ordinance to adopt the Comprehensive Plan text amendment.       

RECOMMENDATION:

The Planning and Zoning Board, at its June 9, 2021, meeting, recommend approval of the Comprehensive Plan text amendment and the adoption of the City of Coconut Creek Water Supply Facilities Work Plan update.
