BACKGROUND:
This item was approved on First Reading at the April 27, 2023, City Commission Meeting.
In an effort to increase transparency for businesses, property owners, and individuals seeking to know the permitted and special land uses for properties in a PCD, City staff proposes to codify newly amended or created PCD districts as they come forward through the development review process. Unlike the Master Business Lists for the Business (B), Industrial (I), and Office (O) Districts, individual PCD lists were not previously codified and are kept on file in the Sustainable Development Department. There are 33 individual PCDs throughout the City that originally had similar or individual Master Business Lists. Over the last several years, as various PCDs have been amended, they have been converted to the existing Master Business List when the uses were similar.
DISCUSSION:
The City now proposes to amend the Land Development Code to create Section 13-264, “Master Business List - Planned Commerce District,” to allow for codification of PCD Permitted and Special Land Use Lists that do not strictly conform to one (1) of the existing Master Business Lists. The ordinance also adopts the permitted and special land use list for the Hale PCD for codification directly in the City’s Code of Ordinances. The ordinance deletes hotel use, addresses the existing public school, adds self-storage uses, and permits other retail and office uses generally provided for under the previous use list, but using terminology consistent with the current Master Business List.
The proposed ordinance accompanies the agenda items relating to the Hale (Strada Shopping Plaza) PCD regulating document, two (2) special land use applications, and a site plan.
RECOMMENDATION:
The Planning and Zoning Board, at its April 12, 2023, meeting, recommended approval of the ordinance. Subject to the City Commission’s findings that the proposed uses are deemed appropriate, City staff finds the zoning amendment request consistent with the City’s Comprehensive Plan and recommends approval.
