A MOTION TO RESCIND RESOLUTION NO. 2022-165, APPROVING THE SITE PLAN REQUEST SUBMITTED BY 4161 HILLSBORO, LLC FOR THE PROPERTY LOCATED AT 4161 HILLSBORO BOULEVARD.

BACKGROUND:

At its last meeting, August 25, 2022, the City Commission considered a rezoning, special land use, and site plan for the Leder Hillsboro Planned Commerce District (PCD) to provide for a self-storage facility generally located at 4161 Hillsboro Boulevard.  After extensive discussion, the Commission chose to defer the items in order to allow the applicant an opportunity to address some potential design changes.  The Commission’s formal action was to approve the rezoning and special land use (both were ordinances) on first reading and defer second reading for approximately 30 days.  However, the site plan was a resolution, and the Commission’s 5-0 vote to approve and defer the resolution, had the effect of final approval on the resolution. 

DISCUSSION:

Because the applicant is working to develop revisions to the building, which is the subject of the site plan, the site plan will need to be reevaluated by the Commission after submission of the applicant’s final plans.  To accomplish this, the Commission will need to reconsider Resolution No. 2022-165. To accomplish this at a subsequent meeting, a ‘Motion to Rescind the August 25, 2022 vote to approve Resolution No. 2022-165’ is necessary.  After being seconded, the motion to rescind should be voted on.  If the motion to rescind is approved, it would then be appropriate to immediately vote (by a second motion) to defer the item to the same meeting at which the related rezoning and special land use ordinances will be heard on second reading. 

RECOMMENDATION:

Staff recommends approval of this motion, followed by a motion to defer Resolution No. 2022-165, the site plan for 4161 Hillsboro Boulevard, to a future commission meeting.
