A RESOLUTION AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE THE THIRD AMENDMENT TO THE AGREEMENT WITH BROWARD COUNTY FOR THE INSTALLATION AND MAINTENANCE OF BUS SHELTERS TO PROVIDE FOR THE ADDITION OF THREE (3) NEW BUS SHELTERS AND REMOVAL OF ONE (1) BUS SHELTER.

BACKGROUND:

On August 27, 2013, the City executed an agreement with Broward County, providing for the installation and maintenance of nine (9) bus shelters at various locations around the City. On November 14, 2019, the City approved the First Amendment to the Agreement for the installation and maintenance of twenty (20) new Americans with Disabilities Act (ADA)-compliant bus shelters at various locations throughout the City, which brought the total bus shelter count covered under the agreement to twenty-nine (29). On February 9, 2023, the City approved the Second Amendment to the Agreement for the installation and maintenance of ten (10) new ADA-compliant bus shelters at various locations throughout the City, which brought the total bus shelter count covered under the agreement to thirty-nine (39). One of these shelters was not installed because the right-of-way was insufficient.

DISCUSSION:

This Third Amendment to the Agreement provides for a continued cooperative effort between Broward County and the City to improve local transportation services within the City through the installation of three (3) new ADA-compliant bus shelters at various locations throughout the City, as noted in Exhibit "A" of the attached Third Amendment to the Agreement. This amendment also addresses the removal of one (1) bus shelter from Exhibit "A" that was not constructed due to right-of-way restrictions. Broward County agrees to purchase and install the shelters, with the City agreeing to maintain them after installation. If approved, the total number of shelters the City will maintain for the County will be forty-one (41).
